Article 1 - General Provisions
The user navigating in this area accesses Pantaleo.it, accessible through the url: https://pantaleo.it. Browsing and transmitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site itself indicated therein.
These General Terms and Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the website in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Italian Legislative Decree no. 206/05 as amended by Legislative Decree no. 21/14 and Legislative Decree no. 70/03) by

Before accessing the products delivered by the website, the user must read these General Terms and Conditions of Sale, which are deemed to be fully and unequivocally accepted at the time of purchase.
The user is invited to download and print out a copy of the purchase form and these General Terms and Conditions of Sale, the terms of which Pantaleo.it reserves the right to modify unilaterally and without prior notice.
Article 2. - Purpose
These General Terms and Conditions of Sale regulate the offer, transmission and acceptance of purchase orders of products on Pantaleo.it whereas they do not regulate the supply of services or the sale of products by parties other than the seller that are present on the same site through links, banners or other hypertext links.
Before placing orders and purchasing products and services from third parties, we suggest you check their terms and conditions of sale.
Article 3 - Conclusion of the contract
In order to conclude the purchase contract, the form must be compiled electronically and submitted in accordance with the instructions.
It contains a link to the General Terms and Conditions of Sale, images of each product and its price, the means of payment that can be used, the method of delivery of the purchased products and the related shipping and delivery costs, a link to the conditions for exercising the right of withdrawal, and the method and timing for returning the purchased products.
The contract shall be deemed to have been concluded when the seller receives the form filled in by the user, after checking that the data contained therein is correct.
The purchaser shall be obliged to pay the price from the moment the online order process is completed. This will be done by clicking on the 'Pay Now' button at the end of the wizard.
Once the contract is concluded, the seller takes over the order for processing.
Article 4 - Registered Users
In completing the registration procedures, the user undertakes to follow the instructions on the website and to provide his/her personal data correctly and truthfully.
Once registered, the user will receive a confirmation email to the email address provided by him/her. Confirmation must be communicated within 48 hours at the latest. After this period, in the absence of confirmation, Pantaleo.it shall be released from any obligation to the user.
The confirmation shall in any case exempt Pantaleo.it from any liability regarding the data provided by the user. The user undertakes to promptly inform Pantaleo.it of any changes to their data communicated at any time.
If the user then communicates inaccurate or incomplete data, or even if there is a dispute by the parties concerned regarding the payments made, Pantaleo.it shall be entitled not to activate or to suspend the service until the relevant shortcomings have been remedied.
On the occasion of the user's first request for activation of a profile, Pantaleo.it shall assign him/her a username. The user acknowledges that such identifiers constitute the system for validating the user's access to the Services and the only way of identifying the user such that the actions performed through such access shall be attributed to him/her and shall be binding upon him/her.
The user undertakes to keep his access data secret and to guard them with due care and diligence and not to pass them on, even temporarily, to third parties.
Article 5 - Product availability
Product availability refers to the actual availability at the time the buyer places the order. This availability must however be considered purely indicative because, due to the simultaneous presence of several users on the site, products may be sold to other customers before the order is confirmed.
Even after sending the order confirmation by e-mail, some goods may become partially or totally unavailable. In such cases, the order will automatically be rectified by deleting the unavailable product and the purchaser will be informed immediately by e-mail.
The information on the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which, therefore, Nicola Pantaleo S.p.A. cannot be held liable, except in case of intent or gross negligence.
Nicola Pantaleo S.p.A. reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to change or update information at any time without prior notice, without prejudice to the Customer's rights under these General Conditions and the Consumer Code.
Except in the event of wilful misconduct or gross negligence, any right of the Customer to compensation for damages or the payment of compensation shall be excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and/or property, caused by the non-acceptance or non-fulfilment, even partial, of an order.
Article 6 - Products Offered
Pantaleo.com sells: Olive oils and derivatives. The offer is detailed on our website.
Article 7 - Transport and Delivery
Products purchased on the website shall be delivered to the address indicated by the Customer during the purchase process in the field "Shipping address".
All purchases will be delivered by the Mail Boxes Etc. express courier service (hereinafter "Courier") from Monday to Friday, excluding public holidays and national holidays.
Nicola Pantaleo S.p.A. shall not be liable for unforeseeable delays or delays not attributable to it.
Once the Products have been shipped, the Customer will receive a confirmation email including a link which he/she can use to track the shipment.
Article 8 - Payment Methods and Prices
The price of the products shall be as indicated on the website from time to time, except where there is an obvious error.
In the event of an error, Pantaleo.it shall notify the purchaser as soon as possible, thus enabling the Customer to confirm the order at the correct price or to cancel. In any event, there shall be no obligation for Pantaleo.it to supply the goods at the erroneously indicated lower price.
Website prices shall include VAT and shall not include shipping costs. Prices are subject to change at any time. The changes do not affect orders for which order confirmation has already been sent.
Once the desired products have been selected, they will be added to the shopping cart. Simply follow the purchase instructions, entering or verifying the required information at each step of the process. Order details may be changed before payment.

Article 9 - Delivery
Pantaleo.it ships throughout Italy, excluding the Vatican City State and the Republic of San Marino.
Delivery is generally made within 3 working days, or, if no delivery date is specified, within the time limit estimated when selecting the delivery method and, in any event, within a maximum of thirty days from the date of confirmation.
If delivery is not possible, the order will be returned to our warehouses. In that case, a message will be sent to the user to specify the location of the order and how a new delivery can be arranged.
If you are unable to be present at the delivery location at the agreed time, please contact us again to arrange a new delivery date.
If delivery cannot take place for reasons not attributable to us after thirty days from the date on which the order is available for delivery, we shall assume that you intend to terminate the contract.
For non-delivery, Nicola Pantaleo will refund the amount of the returned goods within 30 days of receipt, net of transport costs for the return amounting to € 6.90, using the same method of payment used at the time of purchase.
Article 10 - Risk transfer
Risks relating to the products shall be transferred to the buyer from the time of delivery. Ownership of the products shall be deemed to have been acquired upon receipt of full payment of all sums due in respect thereof, including delivery charges, or upon delivery, should this occur at a later date.
Article 11 - Warranty and Commercial Compliance
The seller shall be liable for any defect in the products offered on the site, including non-conformity of the items to the products ordered, pursuant to the provisions of Italian law.
In the event of non-conformity, the purchaser who has entered into the contract as a consumer shall be entitled to have the products restored to conformity free of charge, by repair or replacement, or to obtain an appropriate price reduction or termination of the contract in respect of the disputed goods and the consequent refund of the price paid.
All return costs for defective products shall be borne by the seller.
In case of conformity defects of Products sold by Nicola Pantaleo S.p.A. the Customer shall immediately contact Customer Service.
The legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code apply to the sale of Products. The Customer has the right, at his or her choice and provided that the type of Product allows it, to have the conformity of the Product restored, free of charge, by repair or replacement, or to an appropriate price reduction, or to termination of the contract. The Customer shall forfeit such rights if he/she does not inform Nicola Pantaleo S.p.A. of the lack of conformity within ten days from the date on which he/she discovered the defect, provided that it is not a Product which by its nature is perishable or subject to expiry in a shorter period, in which case the defect must be reported within such reduced period.
Article 12 - Cancellation
The customer has the right to request the cancellation of the order, without giving a reason, as long as the order is not already being processed. Therefore, from the moment the order status changes to “being processed", the user shall no longer be able to cancel the order.
If the buyer requests cancellation of the order, terminating the contract, Pantaleo.it shall refund the amount paid, including shipping costs, where applicable, within 30 days from the time Pantaleo.it has become aware of the buyer's decision to terminate the contract.
Cancellation of an order shall be notified by the customer by e-mail to info@pantaleo.it.
Article 13 - Withdrawal
The Customer has the right to withdraw from the purchase contract for any reason whatsoever, without explanation and without penalty, without prejudice to the cases of exclusion provided for in Section III below.
To exercise this right, the Customer shall send to Nicola Pantaleo S.p.A. a communication within 15 days from the date of receipt of the Products.
If the Customer intends to exercise withdrawal before having received the Products, notice of withdrawal may be sent at any time prior to their receipt.

specifying the description and quantity of the products to be returned.
After receiving the Customer's communication, Nicola Pantaleo S.p.A. shall notify the Customer by e-mail of the Case Number that must be indicated when returning the package. The return shall take place within 15 (fifteen) days from the date on which the Customer communicates his wish to withdraw from the order.
The right of withdrawal is governed by the following conditions:
I.The right applies to the purchased Product in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise the right of withdrawal only for part of the purchased Product.
II.In case of exercise of the right of withdrawal, Nicola Pantaleo S.p.A. shall refund the customer the full amount of the returned goods within 30 days from the date of receipt of the returned products. Refunds will be made using the same method of payment used by the Customer, unless the Customer has expressly requested a different method.
III.In addition to the cases mentioned in the Preamble (non-consumer customer and/or customer requesting an invoice), the right of withdrawal shall be excluded in the following cases, pursuant to Article 59 of Italian Legislative Decree 21/2014:
- order of customised or otherwise clearly personalised products;
- order of products that are likely to deteriorate or expire rapidly
- order of sealed Products that are not suitable for return for hygiene-related or health protection reasons or that have been opened after delivery.
For reasons of hygiene and protection of Customers, the right of withdrawal is applicable only for Products purchased on the website that can be returned to Nicola Pantaleo S.p.A. and placed back on the market without any danger to the health of consumers.
In cases of exclusion of the right of withdrawal and where the products are still fit for sale, Nicola Pantaleo S.p.A. shall donate them to charity.
Shipping costs shall be borne by the customer pursuant to Italian Legislative Decree 185/99 which provides that the consumer has the right of withdrawal without penalty and that the only costs to be borne by the consumer are those of returning the product.
The goods must be returned undamaged and sealed, preferably in their original packaging or in another suitable form of packaging to preserve the products from the risk of breakage or damage, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, Nicola Pantaleo SpA shall refund only the amount of the products subject to withdrawal within a maximum period of 30 days from receipt of the returned products.
The website shall carry out the refund using the same means of payment chosen by the purchaser at the time of purchase.
Article 14 - Data processing
The purchaser's data shall be processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the specific section containing the information pursuant to Article 13 of Legislative Decree dated 30 June 2003 and Article 13 of EU Regulation 2016/679 (Privacy Policy).
Article 15 - Severability
Should any of the clauses of these General Terms and Conditions of Sale be null and void for any reason whatsoever, this shall in no way affect the validity of and compliance with the other provisions of these General Terms and Conditions of Sale.

Article 17 - Applicable Law and Jurisdiction
These General Terms and Conditions of Sale shall be governed by and construed in accordance with the laws of Italy, without prejudice to any other overriding mandatory rules of the purchaser's country of habitual residence. Accordingly, the interpretation, execution and termination of the General Terms and Conditions of Sale shall be subject exclusively to Italian law.
Any disputes inherent and/or consequent thereto shall be settled exclusively by the Italian courts. Where the purchaser qualifies as a consumer, any disputes shall be settled by the court of the purchaser's place of domicile or residence according to the applicable law.
Article 18 - Privacy
To guarantee the processing of personal data (Italian Legislative Decree 196 dated 30.06.2003) the customer hereby expressly allows Nicola Pantaleo S.p.A. to collect and use data for purposes related to carrying out the order.
Users may at any time request information in writing on the data processed and stored, ask for their data to be updated, rectified, supplemented and, where applicable, erased or blocked, by sending an e-mail to info@pantaleo.it
